Terms and Conditions

These terms cover the public Beauty AI Kiosk website and the business service made available through the merchant console and enrolled iPad application. They are written for both website visitors and clothing-store businesses evaluating or using the service.

1. Provider and scope

Beauty AI Kiosk is operated by David Voskanyan, a sole trader in the United Arab Emirates. A person may browse the public website without becoming a customer. The business or organization that registers, starts a test installation, purchases, or uses the service is the “Merchant.” If you act for a Merchant, you confirm that you have authority to bind it to these terms.

By using the website, you agree to use it lawfully. By registering for or using the business service, the Merchant agrees to the full terms below. A separate signed order or checkout confirmation may add terms for a specific purchase. If there is a direct conflict, that order controls only for the subject it expressly covers.

2. Service and iPad application

Beauty AI Kiosk is business software for clothing stores. It includes a browser-based merchant console, an enrolled in-store iPad experience, catalog-aware outfit recommendations, optional consented personal visualization, device administration, store analytics, and a local staff handoff on the same iPad. The Merchant supplies compatible iPads, connectivity, catalog content, store equipment, and staff.

The App Store application is a companion client for an authorized Merchant account. It does not sell subscriptions or process checkout on the iPad. Download and use of the application are also subject to Apple's applicable App Store license terms. These terms govern the Beauty AI Kiosk service and the relationship with the Merchant; Apple's license terms govern the application license where required.

3. Eligibility and accounts

The Merchant must provide accurate business and billing information, keep credentials and enrollment codes secure, permit access only to authorized personnel and devices, and promptly report suspected unauthorized access to team@beautyai.app. The Merchant is responsible for activity under its account and for compliance with the location, device, staff, and usage limits of its plan or order.

The service is intended for business use. The Merchant must ensure that in-store users are appropriately supervised and that AI features are not used by anyone prohibited by applicable law or the relevant third-party provider terms.

4. Merchant content and responsibilities

The Merchant retains ownership of its catalog, logos, product images, prices, inventory, and other content. It grants Beauty AI Kiosk a limited right to host, process, reproduce, and display that content only as needed to provide, secure, support, and improve the service.

The Merchant is responsible for:

  • having the rights and permissions needed for submitted content;
  • keeping product, price, size, inventory, SKU, and location data accurate;
  • providing notices, supervision, and consent required for in-store use;
  • confirming final availability, fit, price, and suitability before relying on a recommendation or completing a retail sale;
  • complying with applicable retail, privacy, employment, consumer, and marketing laws.

5. Test installation

An eligible new Merchant account may receive one cardless test installation. The test starts when the Merchant's first iPad is successfully connected to the workspace, not when the account is registered or an administrator signs in. Unless a different written offer is shown, it then ends at the earlier of 30 days or 500 successful displayable visualizations. It may have limited locations, devices, catalog data, support, or features. The test does not automatically convert into a paid subscription and does not authorize a subscription charge. A Merchant may instead begin paid access at any time by completing a separate checkout or written order that displays the price and renewal terms.

6. Plans, checkout, and taxes

Available plans and indicative prices may be displayed on https://kiosk.beautyai.app. The secure checkout displays the final plan, quantity, billing interval, currency, taxes, seller details, and purchase terms before payment is authorized. Those checkout details form part of the order and control over an inconsistent website summary.

Paddle sells and processes website subscriptions as merchant of record unless the order identifies another seller. Paddle handles payment collection, applicable sales tax, fraud checks, receipts, and buyer-side payment support under its checkout and privacy terms. Beauty AI Kiosk does not receive complete payment-card details.

7. Subscription, renewal, and plan changes

Monthly and annual subscriptions renew automatically for the same billing interval until canceled. The Merchant authorizes each recurring charge to the payment method on file. A plan change takes effect according to the amount and date shown before confirmation. Any future price change applies no earlier than the next renewal after reasonable notice, unless law or tax rules require otherwise.

8. Cancellation and refunds

The Merchant may cancel through the customer portal or the management link in its transaction receipt. Cancellation normally takes effect at the end of the current paid billing period, with access continuing until then. Refund eligibility is described in the Refund Policy, the checkout terms, and any mandatory law that cannot be excluded.

9. AI output and limitations

AI recommendations and visualizations may contain errors and may vary between requests. They are not guarantees of fit, appearance, availability, sales performance, or customer preference. The Merchant must not use the service for automated decisions that have legal or similarly significant effects on a person. Personal visualization may be used only after the app obtains the shopper's clear permission for the disclosed AI processing.

10. Privacy and data protection

The Privacy Policy explains how merchant, device, website, and shopper information is handled. The Merchant must not submit unnecessary personal information or sensitive data through catalog or free-text fields. Any required data-processing agreement must be agreed in writing before the relevant deployment.

11. Acceptable use

The Merchant and website visitors must not:

  • use the service unlawfully or violate another person's rights;
  • submit an image without the permission required by law;
  • resell, sublicense, copy, scrape, or reverse engineer the service;
  • bypass billing, plan, security, authentication, or access controls;
  • upload unlawful, infringing, deceptive, malicious, or unauthorized content;
  • interfere with the service or use it to develop a competing model or product, except where applicable law expressly permits it.

12. Intellectual property

Beauty AI Kiosk software, interfaces, documentation, branding, and underlying technology remain the property of David Voskanyan and applicable licensors. Subject to the order, payment, and these terms, the Merchant receives a limited, non-exclusive, non-transferable right to use the service during the authorized test or subscription term for its internal retail operations.

13. Availability, support, and changes

We use reasonable care to keep the service available and secure, but uninterrupted or error-free operation is not guaranteed. Maintenance, third-party services, network connectivity, and events outside our reasonable control may affect availability. We may update or replace features while preserving the material value of an active paid plan. Support is provided through team@beautyai.app according to the applicable plan or order.

14. Suspension and termination

We may suspend access where reasonably necessary to address fraud, security risk, unlawful use, non-payment, provider restrictions, or a material breach. When practical, we will give notice and an opportunity to remedy the issue. Either party may terminate for an uncured material breach. On termination, access ends and outstanding amounts remain payable.

15. Disclaimers and liability

To the fullest extent permitted by law, the service is provided “as is” and implied warranties are excluded. Neither party is liable for indirect, incidental, special, punitive, or consequential loss, or for lost profits, revenue, goodwill, or data. Beauty AI Kiosk's aggregate liability arising from the paid service will not exceed the fees paid for the affected service during the 12 months before the event giving rise to the claim. Nothing excludes or limits liability or mandatory rights that cannot lawfully be excluded.

16. Governing law

These terms are governed by the laws of the United Arab Emirates. Subject to any mandatory rights or jurisdiction that applies to the buyer, the courts of Dubai, United Arab Emirates, have exclusive jurisdiction over disputes relating to the service.

17. Changes and contact

We may update these terms to reflect legal, security, payment, or service changes. Material changes apply prospectively after reasonable notice. Questions may be sent to team@beautyai.app.
